Terms and Conditions
Please read through the terms and conditions thoroughly before enrolling. When enrolling as a member of Burn en Tone 4/49-53 Archer Street Rockhampton City QLD 4700, you agree to the terms and conditions as laid out below.

The studios INTRO SALE introduction offer (valid for 14 days) is only available to brand new clients. You can only purchase the introductory offer once. The introductory offer is non-refundable nor transferable and will activate from the date of your first class booking. Clients found to be buying the First Time Introduction more than once will be suspended and charged any additional class costs they may have incurred.

A minimum of three people is required for a class to proceed. You will be contacted via text, phone or email 2 hours prior to the start of class should it need to be cancelled and your session returned.

Payment must be made prior to booking. To book into a class you must either have pre-purchased sessions in your account or pay at the time of booking in the studio.

Owners and/or instructors reserve the right to restrict clients to a particular class type for safety reasons; and owners and/or teachers reserve the right to turn clients away if they do not have the correct medical clearance.

If a class you want is full, you can sign up for the waitlist. Should a place become available you will automatically be added to the class, prior to 12 hours before the class begins.

The client understands that the timetable is updated regularly and class times are subject to change.

Class Packs are valid for 2 (5 packs) or 4 (10 packs) months from purchase date. Sessions are non-refundable, are not transferable and can be extended if you are injured, in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date.

Sessions are not transferable to another individual and cannot be used by another person. If someone other than the person booked into the class arrives to use the session, they will be asked to create an account and purchase their own sessions.

Gift cards can be used for group classes and privates at Burn en Tone. They are not redeemable for cash and are non transferable. Burn en Tone does not offer refunds, transfers, suspensions or extensions on Gift Cards for change of mind, injury, illness, change of address or any other reason. All purchases are final.
CANCELLATION POLICY

A strict 12 hour cancellation policy applies. Please cancel online or via the APP. If you do not cancel you will forfeit the class credit.

If you are on a weekly membership you will also be charged a cancellation fee of $10 as well as the loss of your class credit.

Private classes must be cancelled prior to 12 hours before the session begins to avoid losing 100% of session cost.

MEMBERSHIP PAYMENTS

The cost of the 2 x weekly membership is $40/week for foundation members, and $45/week normally. Our 4 x weekly membership is $55/week for foundation members and $60/week normally.

All Memberships operate on a weekly autopay schedule from the credit card stored in Mindbody (a secure system), for a minimum term of 12 weeks. After this period, the membership will auto-renew unless cancelled. (see Termination Policy below).

Memberships may be subject to price increase, but will be communicated in writing 4 weeks prior to any change.

If the client membership payment fails leading to an amount owing to Burn en Tone of $100.00 or more, the client will have 3 days to pay their outstanding balance. If the client fails to do so, access to the facility will be temporarily suspended.

Memberships are not transferable.
MEMBERSHIP SUSPENSIONS

At least 7 days written notice is required for membership pauses suspensions. This ensures that the correct measures are put in place to cease credit card payments that are scheduled for the given period.

Suspensions are limited to 10 weeks per year. Please email requests to pilates@burnentone.com.au.

MEMBERSHIP TERMINATION
-
Memberships cannot be terminated until the initial sign up period has been completed (foundation memberships - 26 weeks, normal memberships - 12 weeks).

Burn en Tone requires at least 7 days written notice to terminate membership. Please email a request to pilates@burnentone.com.au.

In the case of long term or permanent injury or illness that prevents the use of our services, immediate membership termination will be permitted. Termination will take effect from the date we receive written confirmation from a medical doctor.

Burn en Tone may terminate a membership without notice for inappropriate, offensive or illegal behaviour, as determined by us, which occurs on our premises or is directed at our staff or other members.

Burn en Tone Pty Ltd may terminate a membership without notice for any reason. Discretion is up to the owner.

YOUR OBLIGATIONS

Clients must bring to each class, grip socks and water bottle.

The client will be given an introductory tour of the facility by an instructor.
-
The instructor will explain to the client how to safely operate the equipment and will have explained to them rules of conduct, behaviour, dress code and other policies or rules in place.

The client agrees that the client will seek the assistance of an instructor before using any equipment that the client is unfamiliar with.
-
The client agrees to inform Burn en Tone promptly if you change your contact or payment details or if there is a change to other relevant personal information, including anything that may affect health or safety.

Out of consideration for the teacher and other clients please don't be late. Please be aware that if you are more than 5 minutes late for a class, your spot may be given to a waitlisted or stand-by client and you may not be able to attend.
CHANGES TO THESE TERMS AND CONDITIONS

We may change these terms and conditions. We will give you 7 days notice to inform you of any significant changes that may affect your membership. Changes to Burn en Tone terms and conditions will be published to the terms and conditions page on the Burn en Tone website.
CONDITION OF HEALTH

You acknowledge the risks and dangers associated with the strenuous exercise that forms part of the services offered by Burn en Tone. This includes, but is not limited to serious bodily injury, death or other damage or injury. You assume all such risks and responsibility for damages, liabilities, losses or expenses which you may incur as a result of your participation.

Each time you use any website, app or facility associated with Burn en Tone, you must ensure you are in good physical condition and know of no medical or other reason why you should not exercise. If unsure, you should not use any Burn en Tone services until you have sought appropriate medical guidance and been medical clearance.

You agree to give us all relevant personal health and fitness information both before and during the course of any exercise program or other activity. You also agree to complete our Pre-Exercise Questionnaire upon our request. In some cases, responses you give will require that you get medical guidance before exercising. You acknowledge that pre-exercise or other screening is no substitute for medical advice and does not guarantee against injury or death.

You promise that information you give us will be true and accurate and not misleading in any way. You must not use any website, app or in-person service from Burn en Tone if you are suffering from any illness, disease, injury or other condition that could be a risk to your health or safety or that of other members and others. We may suspend or cancel your account if we have reason to suspect that you have not complied with this paragraph or these terms & conditions more generally.

Burn en Tone Pilates and Physiotherapy, and its affiliates make no guarantee, warranty, representation or promise of any health outcomes associated with your use of the Burn en Tone services, including but not limited to weight-loss, weight gain or other changes in body composition or your health or wellbeing more generally.​

ELIGIBILITY

For safety and security reasons you must be at least 18 years old to become a member of Burn en Tone Pilates and Physiotherapy. If you are of the age of 14-18, you must have parental consent to engage in any Burn en Tone services. If you are below the age of 18, you must participate with a parent/carer present.
PRIVACY

All personal information that you supply to Burn en Tone Pilates and Physiotherapy will be collected, used, disclosed and managed by Burn en Tone according to the terms of our Privacy Policy, a copy of which is available on this Website. You consent to us dealing with your personal information in accordance with our Privacy Policy. You also agree to use this Website in accordance with any other policies that we publish on this Website from time to time.

You understand that photos, films, videos or audio recordings may be taken for promotional purposes. You agree to these images and recordings being used by Burn en Tone on our website, social media and for other marketing purposes and you assign your rights in any of these materials to Burn en Tone Pty Ltd.
VIDEO AND AUDIO SURVEILANCE

For security purposes, Burn en Tone uses video and audio surveillance equipment to monitor the facility entrances on a 24-hour basis.

By signing this membership contract, you acknowledge and accept that you will be subject to video and audio surveillance and recording.
-
Video and audio surveillance is limited to the reception room, and entry and exit points.​
EQUIPMENT

The client understands and acknowledges that Burn en Tone purchases the equipment within the facility from a third party and therefore does not manufacture any of the fitness or other equipment used in the facility.

The client understands and acknowledges that Burn en Tone is providing recreational services and may not be held liable for defective products or equipment.
LIABILITY FOR PROPERTY

The client understands and agrees that Burn en Tone is not liable for any personal property that is damaged, lost, or stolen while on or around the facility including, but not limited to, a vehicle or its contents or any property left in the Burn en Tone shared storage holes.

The client also understands that if a member causes damage to the Burn en Tone facility or any equipment within, they are liable to Burn en Tone for its cost of repair or replacement.

The client understands that all personal belongings must be stored in the storage holes provided and removed when the client departs the facility.
RISK WARNING

Burn en Tone Pilates and physiotherapy warns that whilst you are on our premises, you are at risk of suffering physical harm or personal injury including broken bones, soft tissue injuries, joint injuries, permanent disability or death. These injuries may occur from you:

slipping on wet flooring;
-
being struck by weights;
-
colliding with equipment, or other Members;
-
engaging in strenuous exercise and activities; or
-
incorrect use of equipment or Club,

You acknowledge that any such injury may result not only from your actions but from the action, omission or negligence of others.

You acknowledge and agree that the above-mentioned injuries and potential causes of injuries are not exhaustive, and there are other unknown or anticipated risks that may result in injury, illness or death.

You acknowledge that whilst every attempt is made to ensure that the recreational services and facilities provided by Burn en Tone Pilates and Physiotherapy are safe, there are some significant and inherent risks involved, and you agree that you are participating voluntarily at your own risk and responsibility, thereby exposing yourself to certain risks.

RELEASE AND INDEMNITY

The client understands that by engaging in any use of the services and facilities provided by Burn en Tone, it is at your own risk and acknowledge that the use of the facility may involve risk of injury, whether caused by you or another party. By signing up to a membership contract, the client agrees that Burn en Tone will not be liable for any loss, injury, damage or theft of property, belonging to or brought onto the Burn en Tone premises by you, or for any death, personal injury or illness on Burn en Tone premises, or from using our facilities or equipment.
